Non-Competition Agreements
It is always important that you protect your customer relationships. Current efforts to cut costs may result in the termination of employment of key employees. In Georgia, following the termination of employment, an employee may compete with their former employer unless they have signed an agreement that restricts their competition. Non-competition agreements are enforceable in Georgia. The attorneys at Rachelson & White have worked in this area of the law for forty years. In many situations, a simple agreement that prohibits the solicitation of your customers is sufficient to protect your business. Also available to you are confidentiality agreements as well as the traditional agreements that restrict an employee from engaging in substantially the same business in a specified territory following termination. The current business environment suggests that this is a good time to consider implementing a procedure to protect your business. The cost of preparing a non-solicitation agreement is not significant, and the same agreement can be used for all of your employees who are engaged in the same type of work. Also, if you do not have a non-competition agreement in place and plan to terminate a key employee, it is a typical practice to use a severance agreement under which you can obtain post-employment protection from competition. Our lawyers can promptly prepare a severance agreement that contains a post-employment restriction if that is needed for your business.
