Practice Areas

We handle many different types of cases, providing each of our clients with personal care and attention.  We offer a combination of  vigorous and experienced advocacy in these principal practice areas:

We’ve built our practice by representing a variety of parties with construction related issues: property owners, contractors, subcontractors, construction managers, sureties, developers, design professionals, material suppliers, and insurers.  We are experts at drafting the legal documentation required in any construction project, including contracts, mechanics and materialmen’s liens, and the various documents necessary for proper and effective statutory compliance with Georgia’s lien laws.

Our construction law practice includes negotiation and  litigation of construction-related disputes in addition to providing all the documents you will need to keep your business running smoothly.   We’ve handled numerous cases at both the trial and appellate level, for both business and individual clients in the construction industry.  Our experience in these matters covers all aspects of the construction process, including:

  • Bidding
  • Contract Formation
  • Contract Performance
  • Construction Defects
  • Insurance and Warranty Issues
  • Claims and Dispute Resolution

For many small businesses, efficient and successful collection of accounts is of the utmost importance to their company’s bottom line.  We take the time and put forth the effort to give each case the individual attention it requires to vigorously protect our clients’ interests.  At Rachelson & White, we strive to deliver our clients both efficiency and work that meet the highest standards, while finding the most effective collection solutions.  Our expertise spans a wide spectrum, including mechanics' liens and materialmen's liens, bond claims, and statutory Notice to Contractor, all the while using information and documents in the most effective and successful way.

  • Bankruptcy and Replevin Law

In today’s volatile economy, more individuals and businesses choose bankruptcy as a solution to their financial problems.  At Rachelson & White, we have extensive experience in the representation of secured and unsecured creditors in all types of bankruptcy matters.  Our creditor clients understand that a bankruptcy filing does not necessarily extinguish all of the rights they may have to recover the amounts owed to them.

Rachelson & White’s attorneys and staff understand that bankruptcy law is full of potential pitfalls and dead ends, and we are experts at helping our clients navigate these difficult areas.  Timeliness is of the essence with the many short deadlines imposed by the Bankruptcy Code and Rules. Our attorneys and staff give the highest priority to such deadlines and to communicating with our clients regarding the important events in the life of a bankruptcy.

Our personal property foreclosure and replevin practice allows us to protect your interests both before and after bankruptcy proceedings.  Replevin cases can present numerous difficulties and complications that can impede the success of a case.  We have the experience to assist our clients in the recovery of property and in identifying and locating the available assets from both secured and unsecured lenders.  And once we have identified these assets, we obtain the necessary writs and work to recover the property quickly and efficiently.

  • Employment Law

Contracts and handbooks are too important to be left to chance.    A poorly prepared employment contract or handbook can wreak havoc on a business.  Employers are not always aware of the legal ramifications of what they say or write in a handbook until it is too late.  We know the potential problems that may be caused by even a minor, seemingly innocuous, misjudgment in the writing of these documents.  We have almost 35 years of experience in drafting employment contracts and employee handbooks, and litigating disputes regarding these documents when necessary.  Rachelson & White will help you protect your business and your relationship with your employees.

  • Real Estate Foreclosures and Transactions

Real Estate Foreclosures are very complicated proceedings, subject to numerous rules and regulations.   Failure to comply with these rules and regulations may result in the dismissal of the proceeding at a substantial loss of time and money to the secured lender.  The secured lender needs experienced legal counsel to avoid these land mines. We assist clients in negotiating settlements and alternative resolutions to foreclosures, including workouts, and deeds in lieu of foreclosure.   Rachelson & White has the necessary experience with all aspects of real estate foreclosures, from the initiation of the action to the final sale of the property

  • Corporate & Transactional Law

At Rachelson & White, the first order of our business is to get to know your business.   We work with you to understand your business goals, challenges and strategies.  We provide practical, innovative and effective solutions to business problems and manage complex transactions.  We offer sound advice and creative solutions to foster the success of our business clients.

We counsel clients from the formative beginnings of their business through growth, maturity and divestiture.   We draft and negotiate contracts, structure employment agreements, create succession plans, and evaluate rights and duties of shareholders, officers and directors.   For closely-held businesses, we custom tailor capital structures, provide guidance in entity choices, structure ownership transfer, create buy-sell agreements, and structure family limited partnerships.
